This Privacy Policy explains how NextPhoto collects, uses, discloses, stores, and protects personal information when you use our websites, software platform, hosted photography galleries, embedded widgets, booking tools, commerce features, QR-based workflows, and related services.

2. Scope of the Policy

This Privacy Policy applies to personal information collected by NextPhoto from account holders, photographers, staff users, gallery visitors, booking customers, order customers, website visitors, and other people who interact with the Services.

If you use NextPhoto on behalf of a studio, school, league, team, organization, or other business, that organization may control certain data processed within its account. In those cases, NextPhoto may act as a service provider or processor on behalf of that customer.

3. Information We Collect

We collect information directly from you, automatically through your use of the Services, and from third parties that help us operate the platform.

4. Information You Provide

  • Account and profile information, including your name, business name, email address, phone number, billing address, login credentials, authentication settings, and account preferences.
  • Customer content and workflow data, including images, videos, gallery names, QR records, rosters, pre-registration data, booking details, contracts, invoices, messaging templates, automation settings, and order data you upload or create.
  • Communications and support information, including emails, support messages, customer service communications, SMS consent data, and records of your interactions with NextPhoto.
  • Payment and subscription information, including subscription selections, billing contacts, invoices, transaction history, order history, and related tax or payment status data. Payment card details are generally processed by third-party payment processors and are not stored in full by NextPhoto.

5. Information Collected Automatically

  • Usage information, including pages viewed, clicks, session activity, gallery interactions, order actions, widget events, and feature usage patterns.
  • Device and technical information, including IP address, browser type, operating system, device identifiers, language settings, referrer URLs, approximate geolocation derived from IP, and diagnostic information.
  • Security and audit data, including login activity, authentication events, fraud-prevention signals, logs, and operational telemetry.

NextPhoto uses cookies, local storage, pixels, analytics tags, and similar technologies to keep you signed in, remember preferences, measure usage, improve performance, detect abuse, and support security and operational functions.

We may also receive roster, registration, or participant information from schools, leagues, teams, event organizers, and photography customers that use NextPhoto for volume, school, or sports workflows.

8. How We Use Your Information

  • Provide, operate, maintain, and improve the Services and user experience.
  • Create and administer accounts, tenant workspaces, galleries, bookings, orders, contracts, subscriptions, and related photography workflows.
  • Host, store, process, deliver, and display images, galleries, files, and related content using secure third-party cloud infrastructure providers.
  • Support QR-code and pre-registration workflows that may associate individuals, athletes, students, or participants with images, galleries, and delivery records.
  • Use automated tools and AI-assisted workflows to support image processing, background processing, tagging, organization, matching, and delivery-related operations.
  • Process payments, subscriptions, refunds, taxes, and billing operations through providers such as Stripe and other service providers.
  • Send operational communications, including account verification, gallery notifications, booking confirmations, contract or invoice notices, order updates, and support messages.
  • Measure usage through analytics tools, understand platform performance, troubleshoot issues, prevent fraud, and improve the Services.
  • Comply with legal obligations, enforce agreements, investigate misuse, and protect the rights, safety, and security of NextPhoto, our users, and others.

9. Disclosure of Personal Information

We may disclose personal information to service providers and subprocessors that help us operate the Services, including cloud hosting, storage, authentication, analytics, messaging, customer support, payment processing, fraud prevention, and security vendors.

We may disclose information to labs, print vendors, shipping providers, or fulfillment partners when necessary to process orders or deliver services requested by a user or end customer.

We may disclose information when required by law, subpoena, court order, or other valid legal process, or when reasonably necessary to protect rights, safety, property, or the integrity of the Services.

We may disclose information in connection with a merger, acquisition, financing, reorganization, sale of assets, or similar transaction.

10. Marketing Communications and Opt-Out

  • You may opt out of marketing emails by using the unsubscribe link included in those communications.
  • NextPhoto may send SMS for account verification, gallery notifications, booking confirmations, and order updates. Message frequency may vary. Message and data rates may apply.
  • You may opt out of SMS by replying STOP where supported. You may reply HELP for assistance where supported.
  • We may still send transactional or service-related communications when necessary to operate your account or complete a requested transaction.

SMS Communications

NextPhoto may send transactional SMS messages related to your account activity.

We do NOT send marketing or promotional SMS messages.

Users must provide explicit consent before receiving SMS messages. Consent is collected via web forms where users enter their phone number and actively select an unchecked checkbox agreeing to receive SMS communications.

Message frequency varies. Message and data rates may apply.

Users may opt out at any time by replying STOP and may request assistance by replying HELP.

We do not share or sell phone numbers to third parties.

11. Photo and Gallery Privacy Controls

NextPhoto provides tools that allow users to configure gallery visibility, passwords, expiration dates, content protection settings, download restrictions, and customer access controls. The user controlling the gallery is responsible for selecting and managing those settings appropriately.

Where galleries involve minors, school photography, sports photography, or pre-registration records, the photographer, school, team, or other customer using NextPhoto is responsible for determining the appropriate privacy settings, consents, and legal notices required for that workflow.

12. User Rights Over Personal Information

Depending on your jurisdiction, you may have rights to request access to, correction of, deletion of, portability of, or restriction of certain personal information, subject to verification and legal exceptions.

If NextPhoto processes personal information on behalf of a photography business, school, or organization, you may need to direct certain requests to that customer as the controller of its account data.

13. Data Retention

We retain personal information for as long as reasonably necessary to provide the Services, comply with legal, accounting, tax, fraud-prevention, recordkeeping, and contractual obligations, resolve disputes, and enforce our agreements.

Retention periods vary depending on the type of information, account status, subscription status, legal obligations, and operational needs. Because storage is not guaranteed forever, users are responsible for maintaining their own backups of important images and records.

14. Data Security

NextPhoto uses administrative, technical, and organizational safeguards designed to protect personal information from unauthorized access, loss, misuse, alteration, or disclosure.

No system is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the security of your credentials and devices.

15. Children Under 13

NextPhoto is a business platform and is not directed to children under 13 as a primary audience. However, users may use NextPhoto in connection with school, youth sports, and other photography involving minors.

When users process information relating to children or minors through NextPhoto, those users are responsible for obtaining any required parental, guardian, school, or organizational consents and for providing notices required by law.

16. California Privacy Rights

For California residents, this section supplements the rest of this Privacy Policy under the California Consumer Privacy Act, as amended by the California Privacy Rights Act.

  • We may collect identifiers, customer records information, commercial information, internet or network activity, geolocation derived from IP or device data, and other categories described in this Privacy Policy.
