1. Purpose
This Acceptable Use Policy explains the rules that apply when you access or use NextPhoto’s websites, software, hosted galleries, widgets, APIs, booking tools, order tools, QR workflows, AI-assisted processing, and related services.
This policy supplements the NextPhoto Terms of Use. Capitalized terms not defined here have the meanings given in the Terms of Use.
2. Lawful Use Only
- You may use the Services only for lawful business and customer-facing photography workflows.
- You may not use the Services to violate privacy, child protection, biometric, consumer protection, advertising, education, intellectual property, or export control laws.
- You may not use the Services in a manner that encourages, promotes, or facilitates illegal conduct by others.
3. Prohibited Content
- Content that is unlawful, infringing, fraudulent, defamatory, threatening, harassing, abusive, hateful, obscene, or sexually exploitative.
- Content that violates any person’s privacy, publicity, confidentiality, or other rights.
- Content involving minors where you do not have all required permissions, notices, and consents.
- Malware, ransomware, spyware, malicious scripts, credential theft tools, or harmful code of any kind.
4. Photography and Consent Responsibilities
You are responsible for obtaining all permissions, releases, notices, and consents necessary for the capture, upload, processing, storage, display, delivery, sale, or sharing of images and related data through NextPhoto.
If you use NextPhoto for schools, sports, leagues, camps, or other workflows involving minors, you are responsible for obtaining any parental, guardian, school, team, or organizational consent required by law or contract.
5. QR, Pre-Registration, and Association Workflows
- You may not use QR-based workflows, roster imports, pre-registration records, or image association tools to misidentify, profile, or track people unlawfully.
- You must ensure names, phone numbers, email addresses, roster records, and QR data entered into the Services are accurate and lawfully collected.
- You may not use NextPhoto to make unlawful automated decisions about individuals or to process biometric or sensitive data in violation of applicable law.
6. Platform Abuse and Security Restrictions
- You may not bypass authentication, tenant boundaries, access controls, plan limits, download protections, payment controls, or security mechanisms.
- You may not probe, scan, scrape, reverse engineer, interfere with, or overload the Services.
- You may not launch denial-of-service attacks, credential stuffing, brute-force attempts, or vulnerability testing without written authorization.
- You may not access or attempt to access another tenant’s data, galleries, orders, settings, APIs, or customer information.
7. Messaging, Notifications, and Marketing
- You may send email or SMS only where you have the required legal basis and consent.
- You may not send spam, deceptive messages, unlawful marketing, or unwanted communications through the Services.
- You must honor opt-out requests and messaging restrictions, including "STOP" or similar revocation requests where applicable.
8. API, Embed, and Automation Restrictions
- You may not use APIs, widgets, embeds, or automation features to replicate, compete with, or expose protected portions of the Services.
- You may not use automated access methods to extract galleries, customer data, pricing, product configuration, or operational data beyond intended functionality.
- You may not circumvent rate limits, credential requirements, billing, or usage restrictions.
9. Commerce and Payment Restrictions
- You may not use the Services for fraudulent orders, payment abuse, chargeback abuse, money laundering, or unlawful sales practices.
- You may not misrepresent products, fulfillment timelines, download rights, refunds, taxes, or customer entitlements.
- You are responsible for your compliance with tax, consumer, and ecommerce laws applicable to your business.
10. Enforcement
NextPhoto may investigate suspected violations of this policy and may remove content, restrict access, throttle usage, suspend features, disable integrations, or terminate accounts where we reasonably believe this policy or applicable law has been violated.
NextPhoto may also cooperate with law enforcement, regulators, schools, payment processors, vendors, and other authorized parties where legally required or reasonably necessary to protect the platform and its users.

If you believe someone is using NextPhoto in violation of this policy, contact services@nextphoto.app with sufficient detail for us to review the issue.
